BP HARDWARE CO., LTD. is a private company established in Thailand, with its main office located at 394/8 Mahachai Road, Samranrad, Phraanakorn, Bangkok 10200THAILAND (the "Company"). The following terms of use ("") establish the rules that you (as an individual) must comply with in any country/"service" in the world.

The Company may revise the terms of service from time to time. 本公司所提供的服務為一個科技平台，讓本公司的手機應用程式或網站的用戶用於租用公共移動電源，包括移動電源租賃軟件的Web服務。除非本公司另有書面同意，本服務僅供您個人而非商業用途使用。
The service provided by our company is a technology platform that allows users of our mobile application or website to rent public mobile power, including the web service of mobile power rental software. Unless otherwise agreed in writing by the company, this service is only for your personal use and not for commercial use.
（1）許可證
(1) License
當您遵守這些條款，本公司授予您有限的、非獨有的、不可授權的、可撤銷的、不可轉讓的許可證，以：（i）訪問和使用個人設備上的應用程式，而訪問或使用內容僅限於您使用的服務;和（ii）訪問和使用可通過本公司服務所獲取的任何內容，信息和相關資料，在每種情況下僅用於您的個人而非商業用途。本公司及負責發出許可證的人士將保留本協議未明確授予的任何權利。
When you comply with these terms, the company grants you a limited, non-exclusive, irrevocable, non-transferable license to: (i) access and use applications on personal devices, and the access or use content is limited to the services you use; And (ii) access and use any content, information and related materials that can be obtained through the services of the Company, and in each case only for your personal and not commercial purposes. The Company and the person responsible for issuing the license will retain any rights not expressly granted in this Agreement.

You may not: (i) delete any copyright, trademark or other proprietary statement from any part of the service; (ii) Except as expressly permitted by the Company, copy, modify, create derivative works on the Company's services, distribute, license, lease, sell, resell, transfer, publicly display, publicly demonstrate, disseminate, broadcast, broadcast or otherwise use the Company's services; (iii) decompile, reverse engineer or disassemble services in a manner permitted under applicable laws; (iv) connect, copy or alter any part of the Services; (v) Cause or start any program or script that damages, indexes, measures the company, or otherwise obtains any part of the service data, or opens programs that overburden the service, or hinders the operation and/or function of any aspect of the service; Or (vi) attempt to gain unauthorized access to or damage any aspect of the Service or its related systems or networks.

（4）第三方服務。

This service may be associated with or provide access to the services and contents (including advertisements) of third parties unrelated to the company. You agree that different terms of use and privacy policies may apply to your use of such third-party services and content. The Company is not responsible for approving such third-party services and contents. In any case, the Company will not assume any responsibility for any products or services of such third-party service providers. In addition, if you use the services accessed by applications developed for Apple iOS and Android mobile devices, Apple Inc., Google Inc. and/or their applicable international subsidiaries and affiliates will become the third party beneficiaries of this contract. These third party beneficiaries are not parties to this contract and are not responsible for providing or supporting services in any way. Your use of these devices to access our services will be subject to the terms of service applicable to third party beneficiaries.

The company is responsible for the daily operation, maintenance and repair of mobile power supply, but this does not mean that the company has the obligation to ensure that all available mobile power supplies are in a fault-free state at any time. Users should confirm the integrity and efficiency of components before using the mobile power supply, and be familiar with the performance of the mobile power supply.
如果使用者發現移動電源壞了，他/她將取消或停止使用服務，並通知公司有關問題。 如果使用者無視損壞的移動電源並繼續使用，使用者將對該行為及有關後果負責。
If the user finds that the mobile power supply is broken, he/she will cancel or stop using the service and notify the company of the problem. If the user ignores the damaged mobile power supply and continues to use it, the user will be responsible for the behavior and related consequences.

You may not authorize a third party to use your account. You may not transfer or otherwise transfer your account to any other person or entity. You agree to abide by all applicable laws when using the service, and you can only use the service in a legal way. When you use this service, you will not cause nuisance, annoyance, inconvenience or property damage to any other party. In some cases, you may be required to provide proof of identity to access or use the service. You understand that if you refuse to provide identification, you may be denied access to or use of the service.

By creating an account, you agree that the service may send you text message (SMS) messages as part of the normal business operation of using the service. If you have questions about receiving SMS messages from our company, you can hi@oleaf.cn Contact our company. If you confirm that you choose not to receive text (SMS) messages, your use of the Service may be affected.
（4）促銷代碼

You agree that the promotion code: (i) must be used for the target audience and purpose in a legal way; (ii) it shall not be copied, sold or transferred in any way, or made available to the public (whether published or otherwise), unless expressly permitted by the company; (iii) The company may revoke any promotional code at any time for any reason, and the company is not responsible for this; (iv) It can only be used according to the specific terms determined by the Company for this promotion regulation; (v) Non-convertible cash; And (vi) may expire before you use them. If the Company determines or believes that the use or exchange of the Promo Code is incorrect, or if fraud, illegality or violation of the applicable Promo Code terms or these terms is found during the exchange of the Promo Code, the Company reserves the right to deduct the credit amount or other benefits obtained by you or any other user using the Promo Code.

It is your responsibility to obtain the data network required to use the service. If you access or use the service from a wireless device, you will be responsible for the data and message transfer rate and costs of your mobile network. You are responsible for obtaining and updating the applications using the service and any compatible hardware or equipment required for updating. The company does not guarantee that the service or any part thereof will operate successfully on any specific hardware or equipment. In addition, service failures and delays may occur due to the use of the Internet and electronic communications.

當移動電源解鎖時，或者當使用者用手機應用程式解鎖移動電源時，使用者租賃移動電源的時間就會開始進行計時。當移動電源被歸還時，租賃期即結束。如果移動電源在租賃期後並未被退回及鎖定在合法和免費的停泊位置，本公司將收取額外費用。
When the mobile power is unlocked, or when the user uses the mobile application to unlock the mobile power, the time when the user rents the mobile power will start to count. The lease period ends when the mobile power supply is returned. If the mobile power supply is not returned and locked in a legal and free parking position after the lease term, the company will charge additional fees.
上進行支付時，您可以選擇與WeCharge合作的第三方支付機構（如Stripe、Alipay HK、Wechat Pay、Apple Pay等支付通道）所提供的支付服务。支付功能本身並不收集您的個人信息，但我們需要將您的充值紀錄及對賬信息與這些支付即可共享以確認您的支付指令完成並支付。
When making payment on, you can choose the payment services provided by third-party payment institutions (such as Stripe, Alipay HK, Wechat Pay, Apple Pay and other payment channels) that cooperate with WeCharge. The payment function itself does not collect your personal information, but we need to share your recharge records and reconciliation information with these payments to confirm that your payment instructions are completed and paid.

You understand that you may be charged for using the service ("fee"). When you use the service, you will pay the fees derived from using the service. Under the law, the charges will include applicable taxes.

The deposit is deducted from your payment card as part of the registration process and paid to the company on the account start date. The amount of security deposit in Hong Kong is 198 Hong Kong dollars.

The deposit is refundable; It takes 1 to 14 days to process the refund.

You agree that such promotional offers and discounts, unless otherwise specified, do not constitute any responsibility for your use of the service or the service you use.

Restrictions on the use of mobile power and other provisions
(1)

· 使用者充分意識到在使用移動電源時不能在危險情況下使用，如使用時不能與水接觸、不能把移動電源接近火種、不能把移動電源折開等，使用者必須保持適當的警惕以避免此類事故。
·The user is fully aware that when using the mobile power supply, it cannot be used in dangerous situations, such as not contacting with water, not approaching the fire, and not breaking the mobile power supply. The user must maintain appropriate vigilance to avoid such accidents.
· 使用者全權負責以謹慎合理的方式操作移動電源。
·The user is solely responsible for operating the mobile power supply in a prudent and reasonable manner.
· 所有移動電源始終是本公司的專屬財產。
·All mobile power supplies are always the exclusive property of the company.
· 本公司無義務提供使用者使用移動電源服務有關的任何種類的保險，如果本公司有購買相關保險，使用者仍然對任何責任、財產損失、人身傷害、損害等作出賠償並負責所有罰款、損失和/或任何形式的費用。
·The company has no obligation to provide any kind of insurance related to the user's use of mobile power services. If the company has purchased relevant insurance, the user still makes compensation for any liability, property loss, personal injury, damage, etc. and is responsible for all fines, losses and/or any form of expenses.
· 如果使用者在操作或管有移動電源時造成財產損失或對另一方造成的傷害，使用者對此類損害或傷害負全部責任。
·If the user causes property damage or injury to the other party when operating or possessing the mobile power supply, the user shall be fully responsible for such damage or injury.
· 使用者應完好無缺地將移動電源退回本公司。
·The user should return the mobile power supply to the company intact.
· 使用者對由於不正當使用或濫用移動電源造成的任何和所有損害以及損害賠償的費用承擔責任。
·The user shall be responsible for any and all damages caused by improper use or misuse of mobile power supply and the cost of compensation for damages.

·The Company provides convenience for leasing mobile power supply, which can only be used by personnel who have agreed to all terms and conditions of this agreement.

在本公司允許使用者參與本計劃並租賃移動電源前，使用者在任何使用移動電源（“使用要求”）期間應執行以下操作：

· 當發現移動電源的任何缺陷、故障或需要維修的移動電源，應儘快通知公司客戶服務部。
·In case of any defect, fault or mobile power that needs to be repaired, the customer service department of the company shall be informed as soon as possible.
· 如果移動電源被盜或在使用者使用移動電源時造成任何人身傷害事故，立即聯繫公司和當地警察.
·If the mobile power supply is stolen or any personal injury accident is caused when the user uses the mobile power supply, immediately contact the company and the local police
爭議解決
Dispute resolution
使用者同意本公司可自行決定是否可就本協議產生的任何爭議到當地管轄的法院提出訴訟，包括但不限於移動電源的使用和/或本公司網站。本協議受地方司法管轄，不受法律衝突規定的約束。
The user agrees that the company can decide at its own discretion whether any dispute arising from this agreement can be brought to a court of local jurisdiction, including but not limited to the use of mobile power and/or the company's website. This agreement is subject to local jurisdiction and is not subject to conflict of laws.
賠償
Compensation
使用者違反本協議和所有與本協議相關或因此產生的聲明時，包括但不限於使用者違反本協議中規定的任何聲明、保證或協議，均須為本公司提供賠償和保護本公司對移動電源的租賃、維護、設計、使用或操作和/或公司網站，即使是由公司的疏忽造成的全部或部分損失，和/或其他人的疏忽，或是目前已知的還是未知的損害。根據本公司的意願，使用者將負責任何索賠的辯護和解決方案，並由使用者補償（前提是在此情況下，本公司可隨時選擇接管控制任何此類索賠的辯護和解決方案）。在任何情況下，使用者均不得在取得本公司書面同意的情況前解決任何索賠情況。
When the user breaches this agreement and all statements related to or arising from this agreement, including but not limited to the user's breach of any statement, warranty or agreement specified in this agreement, it shall provide compensation and protection for the company's lease, maintenance, design, use or operation of mobile power supply and/or the company's website, even if it is caused in whole or in part by the company's negligence, and/or the negligence of others, Or known or unknown damage. At the will of the Company, the User will be responsible for the defense and solution of any claim and will be compensated by the User (provided that in this case, the Company can choose to take over the control of the defense and solution of any such claim at any time). Under any circumstances, the user shall not settle any claim before obtaining the written consent of the company.
作業
Job
本公司可以隨時將任何本協議的權利和義務轉讓給任何一方，恕不另行通知。
The Company may assign any rights and obligations under this Agreement to any party at any time without notice.
不棄權條款
Non-waiver clause
如本公司未能堅持或強制執行本協議任何條款的，本公司不得被視為放棄任何條款或權利。雙方之間的行為和交易紀錄均不得對本協議的任何部分作出修改。本公司的不棄權條款不得被視為放棄任何訴訟或允許繼續違反本協議條款的行為。
If the Company fails to adhere to or enforce any provision of this Agreement, the Company shall not be deemed to have waived any provision or right. No part of this agreement may be modified by the actions and transaction records of both parties. The Company's non-waiver clause shall not be deemed as a waiver of any action or permission to continue to violate the terms of this Agreement.
終止協議
Termination
公司可隨時無原因地終止本協議及相關法律程序，或者向使用者於使用本系統時作出通知。 使用者放棄與任何此類合約終止相關的所有索賠、引起訴訟的費用和/或損害賠償。如果本協議由於特定原因而被終止，使用者將無權退還未使用的租賃期間支付的任何金額。 使用者可隨時終止使用者的租賃計劃;
The company may terminate this agreement and relevant legal procedures at any time without cause, or notify the user when using the system. The user waives all claims, costs and/or damages arising from litigation in connection with any such termination of the contract. If this agreement is terminated for a specific reason, the user will not be entitled to refund any amount paid during the unused lease period. The user can terminate the user's lease plan at any time;
殘存條款
Survival clause
本協議有關限制和排除責任、放棄、承擔風險、擔保和賠償責任的所有條款應在本協議終止後仍然有效，並且在本協議終止或到期時未支付的所有款項應依然被視為應付款項。
All provisions of this Agreement relating to the limitation and exclusion of liability, waiver, assumption of risk, guarantee and indemnity shall remain in force after the termination of this Agreement, and all amounts unpaid at the time of termination or expiration of this Agreement shall still be deemed to be payable.

"Personal data" in this agreement refers to the information that can identify you, including but not limited to your name, gender, ID card number, birth certificate number, passport number, nationality, address, telephone number, details of credit or debit card, race, preference, date of birth and e-mail address. Any information you provide to the Company about your registration form, application form or any other similar form and/or the information you have collected, stored, used and processed by the Company from time to time, including sensitive personal data, such as data related to health, religion or other similar beliefs.
